If you have been arrested for a DUI in Chico, the DMV will convene for a hearing to discuss your driving privilege and the circumstances surrounding the arrest. The DMV hearing is not a criminal proceeding. Your guilt or innocence is not at question, it is an administrative action to discuss suspension or revocation of your driving privilege only.
The DMV is required by law to suspend or revoke the driving privilege of any person arrested for driving under the influence of drugs, whose BAC level is 0.01% or higher while on DUI probation, 0.04% while driving a commercial vehicle, and/or a 0.08% or more while driving a noncommercial vehicle.
Additionally, DMV is required by law to revoke or suspend a license for anyone who refuse to take a blood or breath test or fails to complete the test.
